A man who fell off his moped in the middle of the road outside the Cirencester pub where he had been drinking was more than twice the legal drink-drive limit a court heard today.

Andrew Hurt, 24, Carterton, Oxford, pleaded guilty at Cheltenham Magistrates Court to driving with excess alcohol.

Hurt had been drinking in The Fox public house in Sherbourne Road, Cirencester on January 28.

A witness saw him pacing up and down outside the pub while his moped was lying in the middle of the road, the court heard.

Prosecuting lawyer Sonia Allford said: “The witness telephoned the ambulance service at 11.45pm and when the paramedics and the police arrived the defendant admitted that he had been drinking in The Fox.”

A breath test revealed that he had 75 microgrammes of alcohol in 100 millilitres of breath, the legal limit being 35 microgrammes.

The defendant, who was unrepresented, said in court: “I would like to apologise.

"This was entirely out of character for me – a big mistake.

"It is fortunate that no-one else was involved.

"It won’t happen again.”

Magistrates banned Hurt from driving for 20 months, fined him £120 and ordered him to pay prosecution costs of £85.
