Outrage over stolen money at Lewis Lane Playgroup

ANGRY playgroup leaders, who were rocked when a colleague stole £9,000 from the charity, have called for justice after discovering they may not have the stolen money repaid.

Last month, Claire Thompson from Cirencester walked away from Cheltenham Magistrates Court after admitting that she had stolen £9,000 from the Lewis Lane Playgroup between September 2011 and April 2012, when she was treasurer of the charity.

The 36-year-old was given a 26-week prison sentence, suspended for two years, was ordered to pay back £9,000 to the centre and carry out 200 hours of unpaid work in the community.

But this week, committee members and staff at the Cirencester playgroup were shocked to receive a letter from the court, explaining that the mother-of-two would be paying back only £5,000 of what she owes at a rate of £40 a month.

Playgroup committee chairman Kelly Motti said: "We were stunned. Not only is she not paying it all back, it’s going to take more than ten years for her to pay it off."

A Standard campaign helped to save the playgroup from closure in June after readers raised £8,000 to replace some of the stolen cash.

And Kelly said if it was not for the generosity of the Cotswold community they would now have been sentenced to certain closure by the courts.

"To get just under half of the money back at such a small amount per month is almost like she’s got away with it," Kelly said.

"We’re still catching up on bills and debt and there’s no way we could have survived if it wasn’t for the money donated. "They say that crime doesn’t pay but she’s got £4,000 now that she doesn’t have to pay back."

Geoffrey Clifton-Brown, MP for the Cotswolds, said the situation seemed unfair.

"Lewis Lane Playgroup should receive back the full amount that was unlawfully taken from them," he said. "I will be writing to the playgroup to offer my assistance."

The Lewis Lane Playgroup committee have submitted a complaint to court legal advisors and are waiting for a response.

Cheltenham Magistrates Court was unavailable to comment as the Standard went to press.

I think Cheltenham Magistrates Court needs to give the whole of Cirencester an explanation as to how a common thief can steel this amount of money and only pay back just over half over a period of 10 years. She has quite clearly put this business in serious trouble. If she cannot afford to pay back the full amount then she should serve her 26 week prison sentence. This sentence should have been a deterrent to other thief's. Obviously crime does pay as she has earned herself £4000. What an outrage.

What an absolute disgrace. Just shows how pathetic our justice systyem is. Where is the deterrent to criminals like her? She shouldn't have even had her sentence suspended in the first place. Lock these evil people up and make them pay the price for their behaviour. Personally I think the magistrates have committed a crime. I hope the CPS have a look at this disgusting decision and appeal against it.

The judgement gives two clear messages, Firstly crime does pay, and second the law is an ****

Remember without criminals the Lawyers police and Judges would be redundant...

I have been following this story since April and although I am out raged at what the guilty person has done surely some questions about how this was possible spring to mind ie were regular checks not carried out and as a member on a committee myself why was this not detected before it go out of control.

Why should these victims be treated differently to anyone else, is it because it has a knock on effect to youngsters, that makes it newsworthy, would it be the same hullabulloo if it was Jim Smith a 55yr old car mechanic?
Treat one group better than another and you have the bane of today's society, discrimination.
You only have to scan the papers to see that victims rarely get recompensed fully by Magistrates or Crown Ct, but some compensation is better than none.
There is however another avenue open to the victims, the small claims court, because the amount outstanding will 'only' be £4000, the cost of a summons is about £120, and unlike the Magistates they will go in and have your furniture, car etc to get the money back.
Just a bit of lateral thinking required that's all.

I've been following this case closely from the onset as i too am on a committee. I'm pleased to say we do however have strict checks and security in place in an effort to avoid such instances - a crime has been committed and they're are undoubtedly victims of this crime, it's very warming to see the Cotswold community pull together in the way that it has to raise the £8000 to save their nursery, i'm sure they're are plenty of happy little faces to show for the efforts of good kind folk. It is however my understanding that this young lady did want to do the right thing and did offer to pay back the whole amount but with ALL cases tried and heard in a Magistrates' Court there is a 'cap' on how much compensation can be awarded and this currently stands at £5000. Life is a learning curve for ALL. Hopefully now proper tighter accountancy systems will be used by the nursery to prevent such crimes recurring (and how was it this crime wasn't picked up sooner rather than months down the line? Aren't there insurances in place or perhaps signing over blank cheques would prevent this...) they're are undoubtedly a lot of question marks on how crimes such as this kind are allowed to happen - it's as good as leaving all your doors and windows open when you take a vacation... Prevention is key here.

Reading a few comments above made me really pleased we have a credible justice system in place and not mob rule! The good people of this shire made the nursery whole and the young lady made a terrible mistake and she pleaded guilty and was duly sentenced. Everybody deserves a second chance and as a christian this revenge remarks need to stop please. AUD2012 wise comments thanks

Lets keep being a Christian out of this as somewhere in the Holy Bibble it bangs on about an eye for an eye and a tooth for a tooth, and pertty soon your cutting peoples hands and heads off and saying its Sharia Law.
Senisble option Criminal Loans scheme, Perp gets a criminal Loan to pay off what she stole from the Playgroup and pays it back, if she misses some payments they send the boys round to break her fingers. Simples
